Terms of Service

These Terms govern your use of the SomaPhil application and related services (the "Service"), provided by SomaPhil LLC ("SomaPhil", "we", "us"). By creating an account or using the Service, you agree to these Terms.

1. The Service

SomaPhil is a social fitness platform for logging workouts, meals, hydration, weight, measurements, cardio, PRs, and recovery, and for connecting with other athletes. Features include: AI-generated workout and meal plans, exercise history and progress analytics, streaks and weekly challenges, direct messaging, comments and reactions, crews (group chats, leaderboards and challenges), a public feed and profiles, saved posts and recipes, hydration and supplement tracking, nearby-gyms discovery, verified athlete and creator badges, a creator marketplace with payouts, push notifications, a daily inspiration page, and moderation and safety tools. Availability of specific features may depend on your plan (free or SomaPhil Pro) and your region.

2. Eligibility and accounts

You must be at least 13 years old (or the minimum digital-consent age in your jurisdiction, whichever is higher) to use the Service, and of legal age to enter into a contract to purchase a paid plan. You are responsible for the security of your account credentials and for all activity under your account. You must provide accurate information and keep it up to date. Multiple accounts may be signed in on one device via the account switcher; you are responsible for each account you sign in.

3. Acceptable use and community rules

You agree not to misuse the Service. You may not:

  • Use the Service for unlawful purposes, fraud, or spam;
  • Infringe intellectual property or privacy rights;
  • Post hate speech, harassment, threats, doxxing, sexual content involving minors, graphic violence, self-harm encouragement, or content sourcing or selling illegal substances (including PEDs);
  • Interfere with the security or integrity of the Service (including malware, probing, scraping, or circumventing technical limits, rate limits, or moderation);
  • Reverse engineer, resell, or redistribute the Service;
  • Impersonate another person, misuse verified athlete or creator badges, or falsely claim affiliation;
  • Use direct messaging, comments, crews, or the marketplace to solicit, scam, phish, or send unsolicited advertising.

All posts, comments, crew messages, and DMs may be auto-moderated the moment you submit them. See our Community Guidelines for details.

4. User content

You retain ownership of content you submit (workout logs, meal logs, photos, videos, posts, comments, messages, measurements, and other data). You grant SomaPhil a limited, worldwide, non-exclusive licence to host, store, process, transmit, back up, and display your content solely to provide, secure, and improve the Service, including generating derived data such as thumbnails, previews, aggregated analytics, and personalised recommendations. Public posts and profile content may be shown to other users; private data (such as DMs, private logs, and hidden posts) is only shared as needed to deliver the Service to you and the recipients you choose. You are responsible for your content and confirm you have the rights necessary to submit it.

5. Intellectual property

SomaPhil and its licensors retain all rights, title, and interest in the Service, including software, documentation, branding, and design. We grant you a limited, non-exclusive, non-transferable right to use the Service within the plan you have selected.

5a. Health and safety disclaimer

SomaPhil is not a medical device and does not provide medical, nutritional, mental-health, or professional training advice. Workout plans, meal plans, macro targets, hydration prompts, cardio zones, recovery scores, streaks, AI-generated recommendations, and any other guidance in the Service are for general informational and fitness purposes only. Consult a qualified professional before starting any new exercise or nutrition program, and stop and seek medical attention if you experience pain, dizziness, or injury. You use the Service at your own risk.

5b. Creator marketplace and payouts

Verified creators may list digital fitness products (such as workout programs, meal plans, and coaching content) on the SomaPhil marketplace. Purchases are processed by Paddle as Merchant of Record (see section 6). Creators grant SomaPhil the rights necessary to host, display, sell, and deliver their listings, and are responsible for ensuring listings comply with these Terms and applicable law. Payouts are made through our payments partner, subject to identity verification, minimum payout thresholds, applicable fees and taxes, and any anti-fraud, refund, or chargeback holds. SomaPhil may remove listings, withhold payouts, or terminate creator status for suspected fraud, IP infringement, refund abuse, or Terms violations. Creators are responsible for their own taxes on payouts received.

6. Subscriptions, payments, and refunds — Merchant of Record

Paid subscriptions (e.g. SomaPhil Pro) are sold on a recurring monthly or annual basis and renew automatically until cancelled. Cancellation takes effect at the end of the current paid period; you keep Pro access until then.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Checkout Buyer Terms and Paddle's Refund Policy, in addition to our own Refund Policy.

7. AI features

Some features use generative AI. You are responsible for your prompts, how you use outputs, verifying accuracy, and ensuring you have rights to any input content. AI outputs may be inaccurate and are not a substitute for professional medical, nutritional, or training advice. You must not use the Service to generate illegal content, deepfakes, hate speech, malware, or to jailbreak safety systems. We may remove or restrict content, refuse or filter outputs, and suspend accounts that violate these rules. Repeat infringement may result in termination. To report infringement, contact support@somaphil.com.

8. Suspension and termination

We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may close your account at any time. On termination, your right to use the Service ends; we may delete your data after a reasonable export window, subject to legal retention requirements.

9. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free performance.

10. Limitation of liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, consequential, incidental, or special damages (including loss of profits, data, or goodwill). Nothing in these Terms excludes liability that cannot be excluded by law (such as fraud, death, or personal injury caused by negligence).

11. Indemnity

You will indemnify SomaPhil against third-party claims arising from your content, your unlawful use of the Service, or your breach of these Terms.

12. Changes

We may update these Terms. Continued use after changes take effect constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the jurisdiction in which SomaPhil LLC is established, without regard to conflict-of-laws rules. Disputes will be resolved in the competent courts of that jurisdiction.
